Under Massachusetts General Laws Chapter 276 Section 87, the court may place a person on pre-trial probation.  Pre-trial probation is a very good disposition because a person does not admit guilt or facts sufficient for a finding of guilty.  Pre-trial probation is a court-approved agreement between the Commonwealth and defendant before a trial or a plea. Under this agreement, a defendant’s case will be postponed for a specific period, on certain conditions. If the defendant satisfies the probationary period, the charge(s) will be dismissed. If, however, the defendant picks up a new offense or violates any condition, the charges will not be dismissed and return to the trial docket.  Pre-trial probation is rarely given and only available in limited circumstances with the Commonwealth’s approval. Attorney Hester has considerable experience negotiating for this favorable disposition.

FRAMINGHAM DISTRICT COURT (February 23, 2023)

Client was charged with violating an abuse prevention order. Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation. 

BROCKTON DISTRICT COURT (February 9, 2023)

Client was charged with malicious damage to a motor vehicle, tagging property, trespass, and trespass with a motor vehicle. Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation. 

BROCKTON DISTRICT COURT (February 1, 2023)

Client was charged with negligent operation of a motor vehicle and marked lanes violation.  Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation. 

PLYMOUTH DISTRICT COURT (December 20, 2022)

Client was charged with negligent operation of a motor vehicle, unlicensed operation of a motor vehicle, and window obstruction.  Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation.

ATTLEBORO DISTRICT COURT (June 13, 2022)

Client was charged with larceny under $1,200.00.  Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation.  On December 13, 2022, the charges were dismissed after pre-trial probation.  On March 30, 2023, Attorney Hester successfully convinced the Judge to seal the record of this offense.   

PLYMOUTH DISTRICT COURT (May 14, 2021)

Client was charged with breaking and entering a building in the daytime with intent to commit a felony.  Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation.  On February 14, 2022, the charge was dismissed after pre-trial probation.

BROCKTON DISTRICT COURT (March 15, 2021)

Client was charged with negligent operation of a motor vehicle and marked lanes violation.  Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation.  On September 13, 2021, the charges were dismissed after pre-trial probation.

TAUNTON DISTRICT COURT (November 16, 2020)

Client was charged with vandalizing property and disorderly conduct.  Attorney Hester, on behalf of his client, applied for pre-trial probation. The Commonwealth agreed and the Judge ordered pre-trial probation.  On November 15, 2021, the charges were dismissed after pre-trial probation.
