Under Massachusetts General Laws Chapter 276 Section 87, the court may place a person on pre-trial probation. Pre-trial probation is a very good disposition because a person does not admit guilt or facts sufficient for a finding of guilty. Pre-trial probation is a court-approved agreement between the Commonwealth and defendant before a trial or a plea. Under this agreement, a defendant’s case will be postponed for a specific period, on certain conditions. If the defendant satisfies the probationary period, the charge(s) will be dismissed. If, however, the defendant picks up a new offense or violates any condition, the charges will not be dismissed and return to the trial docket. Pre-trial probation is rarely given and only available in limited circumstances with the Commonwealth’s approval.
