Have you or a loved one received notice of a Clerk Magistrate’s Hearing? If so, it is imperative that you seek professional legal representation right away.  Attorney James Hester has extensive experience representing clients at Clerk Magistrate Hearings. Every court handles a magistrate hearing differently. Some in person, some by video, and some by telephone.  If you have questions about a Clerk Magistrate Hearing, don’t hesitate to call Attorney Hester to set up a confidential, no obligation consultation.

A Clerk Magistrate’s Hearing is one of the ways in which a person in Massachusetts can be formally charged with a criminal offense. A hearing is held where a magistrate determines whether there is probable cause to charge a person with a crime.  If the magistrate determines that probable cause exists, a criminal complaint issues and the individual will receive a summons by mail ordering him or her to appear in court as a defendant in a criminal case.  If the magistrate does not find probable cause or defers his or his decision, then a criminal complaint is not issued, and the defendant will not be charged with a crime.  There is a lot at stake in a Clerk Magistrate Hearing. If you are facing one, you should contact Attorney Hester immediately.  At a hearing, Attorney Hester can present evidence, cross-examine witnesses, and persuade the magistrate that probable cause was not met or that justice can be served by other means.
